Chapter 8: The Wife Who Wanted Me Declared Unfit
At nine forty-five Friday morning, I stood outside Lakeshore Behavioral Assessment with Margaret beside me.
I had not come to undergo the evaluation Vanessa had arranged. I had come to dispute the authorization, obtain clarification about the records, and ensure that no one mistook my presence for consent.
The receptionist directed us to a small conference room.
A woman named Dr. Helen Brooks entered a few minutes later. She wore a gray suit and carried a thin folder.
"Mr. Mercer, Ms. Ellis," she said.
"Thank you for coming. Before we discuss anything, I want to make clear that we have not made any determination about Mr. Mercer's capacity.""
"Good," Margaret replied.
"Because he did not request this appointment.""
Dr. Brooks nodded.
"We understand that the referral has been disputed. We are reviewing the documentation and will follow our professional obligations.""
She opened the folder.
"The appointment was requested by Mrs. Mercer, who identified herself as your spouse. She expressed concerns about your recent behavior and asked whether a clinical assessment might help resolve a family dispute.""
"Did she say I had agreed to attend?"" I asked.
"She indicated that you were aware of the appointment.""
"I wasn't.""
Dr. Brooks made a note.
"She also submitted a signed authorization.""
"I did not sign it.""
"That is something we will need to investigate before determining how to proceed.""
Margaret slid a copy of the disputed form across the table.
"We have reason to believe the signature may have been copied from another document. We ask that the original be preserved and that the clinic refrain from relying on the disputed statement until the issue is resolved.""
Dr. Brooks examined the form.
"I can assure you that we will document your objection and refer the matter to our compliance department.""
I felt a fraction of the tension leave my shoulders.
Then she turned to another page.
"There's a second document we need to discuss. Mrs. Mercer provided a written account of several incidents she described as concerning.""
I looked at Margaret.
She nodded for Dr. Brooks to continue.
"According to the statement, you have recently become suspicious of family members, accused your wife of financial misconduct, and threatened to remove her from the household. It also claims you have repeatedly forgotten previous financial agreements.""
"That's false," I said.
"I discovered transfers from my daughter's education account that I had never authorized. I also found an attempted transfer from my personal reserve account.""
Dr. Brooks looked up.
"Do you have documentation?""
"Bank records, communications, and an ongoing investigation.""
Margaret provided a summary without disclosing unnecessary confidential information.
Dr. Brooks reviewed the documents carefully.
"I'm not in a position to determine the truth of the underlying financial dispute," she said.
"However, the context is important. A disagreement over money does not, by itself, establish a mental health condition or incapacity.""
"Then why did my wife arrange this appointment?""
"I can't speak to her motives.""
I leaned forward.
"She wants to manage my finances.""
Dr. Brooks didn't answer immediately.
Then she said, "That is a concern you should discuss with your attorney. Our clinic cannot determine who should control your accounts.""
The meeting lasted twenty-five minutes.
By the end, Dr. Brooks had documented that I disputed the referral and denied consenting to the evaluation. She also confirmed that the clinic would not issue a report diagnosing me based solely on Vanessa's statement.
It wasn't a complete resolution, but it was a start.
As Margaret and I walked toward the elevators, she received a message from Claire.
Vanessa had just sent her a photograph of a document labeled *TEMPORARY FINANCIAL MANAGEMENT REQUEST*.
The message beneath it read:
If Daniel refuses to cooperate today, I need you to confirm that his behavior has changed. You know him well enough to tell the truth.
Claire had replied:
I will not make statements about Daniel that I cannot personally support.
Vanessa's response was immediate.
Then don't expect me to protect you when this comes out.
I read the exchange.
"What does she mean by 'this'?"" I asked.
Margaret shook her head.
"We need to ask Claire, but don't assume we know the answer.""
I called her.
She sounded frightened.
"Vanessa has been calling me all morning," she said.
"She says if I don't support her, she'll tell everyone I helped her take the money.""
"Did you?""
"No. I never touched Maya's account. I only agreed to witness a signature, and I refused when I realized I didn't understand the document.""
"Then preserve every message and speak with your own attorney if you need advice.""
"I will.""
She paused.
"Daniel, there's something else. Vanessa said she has a meeting with someone at two o'clock today. She told me it was the last step.""
"What last step?""
"I don't know. But she said after today, you wouldn't be able to stop her.""
The elevator doors opened.
Margaret and I stepped inside.
"Do you know where she's going?"" I asked.
"She mentioned a private banking office.""
My stomach tightened.
"Which bank?""
"She didn't say.""
I thanked Claire and ended the call.
Margaret immediately contacted the bank's fraud department and informed them of the disputed authorization and the attempted transfers. The bank confirmed that no change to account ownership or management had been approved.
However, a separate request for information about my personal reserve account was pending review.
The request claimed to have been submitted by my authorized representative.
The representative named on the form was Vanessa.
I had never appointed her to that role.
We spent the next hour providing documentation and requesting that the bank flag the disputed request. The bank agreed to investigate, though it could not promise an immediate outcome.
At twelve thirty, I returned home.
Vanessa was in the living room, dressed in a navy suit. A leather handbag sat beside her, and her car keys were placed neatly on the coffee table.
She looked up when I entered.
"How was your appointment?""
"I disputed it.""
Her smile disappeared.
"You didn't even try.""
"There was nothing to try. I never consented.""
She picked up her handbag.
"You've made a terrible mistake.""
"Then explain it.""
She gave a short laugh.
"You still believe this is about tuition. It isn't.""
I felt my pulse quicken.
"Then what is it about?""
Vanessa walked toward the door.
"Ask Margaret to explain what happens when a family can no longer trust the person controlling its assets.""
"You're not controlling my assets.""
"Not yet.""
She opened the door.
I stepped aside, refusing to block her path.
"Where are you going?""
"To take care of something you've neglected.""
She left.
I watched her drive away, then immediately called Margaret.
"She's heading to a meeting. Claire believes it's at a bank.""
"We've already alerted the bank," Margaret said.
"Don't follow Vanessa or confront anyone. I'll contact the institution directly.""
I spent the next two hours trying to work while waiting for updates.
At three fifteen, the bank called.
The pending request had been withdrawn before it was processed.
But the representative handling the case had found something else.
A separate inquiry had been made about the possibility of appointing a financial guardian if I were declared unable to manage my affairs.
No appointment had been made. No formal finding of incapacity existed.
Still, the inquiry had been made.
And the person listed as the proposed guardian was Vanessa Mercer.
I sat at my desk, staring at the notes I'd taken.
She had tried to move money from my accounts.
She had tried to gain access to Maya's trust.
She had arranged an evaluation without my consent.
Now she was asking what would happen if I were declared incapable of managing my own finances.
The pattern was no longer subtle.
Vanessa wanted control.
And she was looking for every possible route to obtain it.
At four o'clock, Margaret called with an update.
"There's one more document we need to discuss," she said.
"The bank provided a copy of the proposed guardianship inquiry. It includes a declaration from a person claiming to have observed your behavior over several months.""
"Vanessa?""
"No. Someone else.""
My stomach tightened.
"Who?""
Margaret paused.
"The declaration is signed by your former business partner, Michael Grant.""
I stared at the wall.
Michael and I had worked together for twelve years before separating our business interests amicably. He had attended my wedding to Vanessa and had visited our home several times.
He knew Maya.
He knew my mother.
And he knew that my wife had recently begun accusing me of being unstable.
"Why would Michael sign something like that?""
"I don't know. We need to ask him.""
I called Michael immediately.
He answered after three rings.
"Daniel.""
"Michael, I need to ask you about a declaration you apparently signed concerning my mental capacity.""
Silence.
Then he said, "I was wondering when you'd call.""
My chest tightened.
"What did Vanessa tell you?""
He exhaled.
"She said you were having a breakdown and that you were threatening to destroy your family over a financial misunderstanding.""
"And you believed her?""
"I believed you were under a lot of stress. She said she was trying to protect Maya.""
"Did you sign a declaration saying I was incapable of managing my affairs?""
"I signed a statement describing what she told me. I didn't realize it would be used that way.""
"Did you personally witness the behavior she described?""
He hesitated.
"No.""
The answer came quietly.
But it came.
"Michael, you need to understand that someone is trying to use your statement to gain control of my finances.""
"I understand that now.""
"Will you correct the record?""
"Yes.""
His voice grew strained.
"But Daniel, before I do, there's something you should know. Vanessa showed me a photograph of a document she said Laura had prepared before she died.""
My heart slammed against my ribs.
"What document?""
"A letter. She claimed Laura had warned people that you might become unstable under pressure.""
I felt sick.
"That's not true.""
"I know that now. Vanessa said the original was missing, and she needed help finding it.""
I gripped the phone.
"Did she show you the letter?""
"No. Just a photograph of one page.""
"What did it say?""
Michael was silent for a moment.
Then he answered.
"It said that if you ever became unable to protect Maya's inheritance, control should pass to a trusted family member.""
I closed my eyes.
"Who did she claim that family member was?""
May you like
Michael's answer came in a whisper.
"Vanessa.""
