Chapter 9: The Custody Trap

Marcus spent the next three hours in a police interview room.

He answered every question.

He provided copies of the storage-unit receipt, the medical report, the recordings, and the photographs showing Vanessa with Daniel.

The officer listened without interrupting.

When Marcus finished, he leaned back.

"Mr. Hayes, I want to be clear. We're not making a determination about custody here.""

"I understand.""

"But the complaint is serious. Your wife alleges that you removed property belonging to the estate and threatened her.""

Marcus looked directly at him.

"That property belongs to my daughter.""

"That's something the court will need to determine.""

Marcus exhaled.

"Can I go home?""

"Yes. But we recommend that you avoid direct contact with Mrs. Hayes until the hearing.""

Marcus gathered his belongings.

As he walked toward the exit, his phone vibrated.

A message from Rachel.

*Maya is asking for you. She's scared.*

He called immediately.

"Put her on.""

Rachel answered softly.

"She's right here.""

"Daddy?"" Maya whispered.

"I'm coming home, sweetheart.""

"Are you in trouble?""

Marcus closed his eyes.

"No. I'm coming home.""

"Vanessa called the school.""

His stomach tightened.

"What did she say?""

"She told them she was coming to get me.""

Marcus stopped walking.

"Did they let her?""

"No. Aunt Rachel came to pick me up.""

He exhaled.

"Good.""

Maya hesitated.

"Daddy?""

"Yes?""

"She said you're not my real father.""

Marcus gripped the phone.

"She lied.""

"She said I have to go with her because Mommy wanted it.""

Marcus's voice softened.

"Your mother wanted you to be loved. She wanted you to be safe. And she wanted me to raise you. Nothing Vanessa says changes that.""

Maya began crying.

"I don't want to go.""

"You won't be alone. I promise.""

At home, Patricia was waiting with another attorney.

Her name was Evelyn Grant, a family-law specialist.

She reviewed Vanessa's custody petition and immediately noticed several problems.

"These documents appear to rely on the temporary guardianship clause from the original estate papers," Evelyn explained.

Marcus sat across from her.

"But Elena revoked it.""

"That's what we need to prove.""

Patricia placed the amended will on the table.

"The original was witnessed and notarized. It also specifically names Marcus as Maya's sole legal guardian.""

Evelyn examined the signature.

"Do we have the notary's records?""

"Yes. The notary is still practicing.""

"Then we'll request a sworn statement.""

Marcus looked toward the hallway.

Maya was sitting on the stairs, listening.

He walked over.

"Sweetheart, you should be in bed.""

"Are you going to court?""

"Yes.""

"Can I come?""

He knelt.

"I hope you won't have to.""

Maya hugged him.

"Please don't let Vanessa take me.""

Marcus held her.

"I won't stop fighting for you.""

The following morning, the custody hearing took place in a family courthouse.

Vanessa arrived with Daniel.

She wore a dark blue dress and carried herself with the confidence of someone who believed the outcome was already decided.

Daniel sat beside her, whispering into her ear.

Marcus noticed that Vanessa held his arm whenever the judge looked in their direction.

It was an act.

A performance.

Evelyn leaned toward Marcus.

"Don't react to anything they say. Let me handle it.""

The hearing began.

Vanessa's attorney spoke first.

He described her as a loving stepmother who had been unfairly excluded from Maya's life.

He presented photographs of Vanessa celebrating birthdays with Maya, helping her with homework, and taking her to the park.

Then he presented the medical report showing that Daniel was Maya's biological father.

Marcus stared at the screen.

Vanessa lowered her head as though she were grieving.

Her attorney continued.

"Mrs. Hayes is concerned that Mr. Hayes has concealed important information about the child's biological identity and has become increasingly unstable since discovering the truth.""

Evelyn stood.

"Your Honor, we object to the characterization of Mr. Hayes as unstable. He has been Maya's primary caregiver since birth.""

The judge raised a hand.

"Proceed.""

Evelyn presented the original legal declaration confirming Marcus's parental rights.

She then submitted the amended will.

Vanessa's attorney objected.

"Your Honor, we question the authenticity of this document.""

Evelyn remained calm.

"We have the notary's sworn affidavit and the original witness signatures.""

The judge examined the documents.

"Mrs. Hayes, did you know about this amendment?""

Vanessa stood.

"Yes, Your Honor. But Elena was extremely ill when she signed it.""

"Are you claiming she lacked mental capacity?""

Vanessa nodded.

"She was heavily medicated.""

Evelyn immediately produced hospital records.

"These records establish that Elena was alert and fully oriented on the date the amendment was executed.""

The judge studied them.

Then he looked at Vanessa.

"Do you have evidence to contradict this?""

Vanessa's attorney requested a brief recess.

During the break, Daniel approached Marcus in the hallway.

"You should settle this.""

Marcus looked at him.

"Get away from me.""

Daniel smiled.

"You think the truth will save you? You don't even know what Elena was planning.""

Marcus stepped closer.

"What else did she discover?""

Daniel's smile faded.

"Ask your sister why she was at the hospital when Elena signed the final papers.""

Marcus stared.

"She told me she wasn't there.""

Daniel shrugged.

"Then perhaps your sister has been lying to you, too.""

Before Marcus could respond, Daniel walked away.

The hearing resumed.

Vanessa's attorney presented a final document.

It was a handwritten statement allegedly signed by Elena three days before her death.

It claimed that Vanessa should become Maya's primary guardian if Marcus ever became unable to care for her.

Evelyn studied it.

"Your Honor, we have serious concerns about the origin of this document.""

Vanessa stood.

"It's genuine.""

The judge examined the paper.

"Where was this found?""

"In Elena's personal belongings.""

Evelyn approached the bench.

"Your Honor, the handwriting on this document differs significantly from Elena's verified writing samples.""

Vanessa's face tightened.

"That's because she was sick!""

Evelyn looked at the judge.

"We request that the document be sent for forensic examination.""

The judge nodded.

"Granted.""

Then he turned toward Vanessa.

"Until the authenticity of these documents is established, I see no basis for transferring guardianship.""

Vanessa's attorney leaned toward her.

She whispered something.

Vanessa suddenly stood.

"This is ridiculous! I'm her stepmother. I've been there for her!""

The judge's expression hardened.

"Mrs. Hayes, sit down.""

Vanessa ignored him.

"Marcus has been hiding the truth about her biological father!""

The judge struck his gavel.

"One more interruption, and I will have you removed.""

Vanessa sat.

The judge issued a temporary order maintaining Maya's current living arrangement with Marcus and prohibiting either party from removing her from the jurisdiction without court approval.

Marcus exhaled.

It wasn't over.

But Maya was coming home with him.

Outside the courthouse, Evelyn gathered the documents.

"We've made progress, but the forged statement could become a serious issue.""

Marcus nodded.

"We'll prove it.""

Then he noticed Rachel standing near the entrance.

She looked terrified.

"Marcus, I need to tell you something.""

He walked toward her.

"What happened?""

Rachel glanced around.

"Daniel called me last night.""

"What did he want?""

"He told me he had proof that Elena's final will wasn't the original.""

Marcus frowned.

"What?""

Rachel reached into her handbag and pulled out a small flash drive.

"He said Elena made another version. One that nobody has seen.""

Marcus stared at it.

"Where did you get this?""

"Daniel left it at my apartment.""

"Why would he give you this?""

Rachel's eyes filled with tears.

"Because he said if I didn't cooperate, he'd tell the police what really happened the night Elena died.""

Marcus felt his chest tighten.

"Rachel, what really happened?""

She looked toward the courthouse.

Then she whispered:

"Elena wasn't alone when she died.""

Marcus waited.

Rachel's voice broke.

"I was there. And so was Vanessa.""

"Who else?""

Rachel looked directly at him.

"Your father.""

Marcus went completely still.

His father had died six months before Elena.

That was what everyone had been told.

But Rachel was already crying.

"Marcus, I know what I saw.""

He looked down at the flash drive.

Then his phone vibrated.

May you like

A new message had arrived from an unknown number.

*Your father is alive. And he knows where Elena hid the real will.*
